Agenda Title:
Authorize Mayor to Sign Settlement and Compliance Agreement in the matter of the May 10, 2013, Air Quality Violations by the City of Rapid City Landfill.
Summary:
The Rapid City Landfill failed to submit the necessary reports and compliance documents to the South Dakota Department of Environment and Natural Resources (DENR) for the year 2012.  The failure to comply with this air quality permit requirement resulted in the DENR issuing a Notice of Violation.  This agreement includes a penalty of $5,775.00.  All activities in the compliance plan have been completed by the Solid Waste Division staff, and the 2013 reports have been submitted in a timely manner.  It is important to note that at no time was there any detrimental impact to air quality at the landfill.
